Payphone Services Terms & Conditions

1. Definition and Interpretations
1.1 In these Specific Terms and Conditions, the following words and expressions shall have the following meanings:
“Customer” means any person who purchases a PhoneCard;
“Cardholder” means the Customer and includes any person authorized by the Customer to use the PhoneCard purchased by the Customer;
“General Terms” means Singapore Telecommunications Limited’s General Terms and Conditions of Service;
“Payphone” means the use of any telephone which requires the insertion of any coin or card (whether cash, credit, debit, stored value or pre-paid) installed or maintained by Singtel or any Singtel Group Corporation;
“PhoneCard” means any pre-paid or stored value card issued by Singtel for use in relation to Payphones;
“Service” means the provision by Singtel of telephone and such other telecommunications service (as may be made available from time to time) through the use of a Payphone.
1.2 The words and expressions used in these Specific Terms and Conditions, which are defined in the General Terms but are not defined in these Specific Terms and Conditions shall have the same meanings as defined in the General Terms unless the context otherwise requires.
1.3 The headings or titles to the Clauses in these Specific Terms and Conditions are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Specific Terms and Conditions.

2. Applications of Terms and Conditions
2.1 The sales and use of all PhoneCards and the use of any Service shall be subject to these Specific Terms and Conditions and the General Terms. The rights and protections conferred on Singtel under these Specific Terms and Conditions shall be additional to the rights and protections conferred on Singtel under the General Terms and any other terms and conditions agreed or accepted by the Cardholder.

3. Services
3.1 The use of any Service shall be subject to such Fees and Charges as may be set or imposed by Singtel from time to time and deducted from the stored value of the PhoneCard used in conjunction with the Service.
3.2 The use of any Service shall be immediately disconnected or terminated once the stored value of any PhoneCard is entirely depleted.

4. Stored Value of Phonecard
4.1 The amount paid for any PhoneCard shall be the value of the PhoneCard and the information or data relating to the value of the PhoneCard shall be stored only in the PhoneCard.
4.2 The stored value of any PhoneCard shall be depleted or deducted at such rate based on the Fees and Charges imposed by Singtel in relation to the utilization of any Service.
4.3 The remaining stored value of any PhoneCard shall be conclusively determined by the equipment designated and used by Singtel to read or check the relevant information or data stored in the PhoneCard. The punch or other marks on any PhoneCard which purport to indicate the remaining stored value of the PhoneCard does not constitute an accurate indication of the remaining stored value.
4.4 Singtel shall not be liable in any way to any Cardholder whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any loss, damage or liability incurred or sustained by the Cardholder caused by or as a result of:
(a) any loss, corruption and/or deletion of any information or data stored in any PhoneCard (including information or data relating to the stored value of any PhoneCard), howsoever caused or arising;
(b) the retention of any PhoneCard inserted into any Payphone; any/or
(c) any defect or deficiency in any PhoneCard, whether or not resulting in the failure of any Payphone or the interruption or cessation of any Service.
4.5 The Cardholder shall before using any Service ensure that there is sufficient remaining stored value in the PhoneCard to cover the Fees and Charges for the use of the Service.

5. Refunds, Expiry, Depletion of Stored Value and Defects
5.1 Singtel shall not in any circumstances be required to give any exchange or cash refund of the stored value of any PhoneCards.
5.2 The PhoneCard may not be used at all after its expiry date and Singtel shall not be required to replace or renew any such PhoneCard or refund the stored value thereof after the expiry of the PhoneCard.
5.3 The Cardholder shall not use any PhoneCard which is found to be defective in any way.
5.4 The Cardholder shall immediately:
(a) return to Singtel any defective PhoneCard; and
(b) report to Singtel in the event that any Payphone retains any PhoneCard.
5.5 Subject to the provisions of Clause 5.2 herein, Singtel shall replace the PhoneCard referred to in Clause 5.4 with another PhoneCard with the same remaining stored value as the PhoneCard returned to or retrieved by Singtel provided that in the event that Singtel is unable for any reason whatsoever to determine the remaining stored value of that PhoneCard, the stored value of the replacement PhoneCard shall be such value as Singtel may determine in its absolute discretion.
5.6 All PhoneCards returned to Singtel or retrieved by Singtel from Payphones shall become the property of Singtel and may be destroyed by Singtel.
5.7 All PhoneCards can only be printed, issued and sold with permission from Singtel. No Cardholder is allowed to print any design, symbols, words or any other kind of mark, in total or in part, over, in or on any PhoneCards without prior written approval from Singtel.

6. General

6.1 The Customer and Cardholder shall be bound by and shall fully observe and comply with all the General Terms as well as such other terms and conditions as may be agreed or accepted by the Customer and Cardholder. The rights and protections conferred on Singtel under these Specific Terms and Conditions shall be additional to the rights and protections conferred on Singtel under the General Terms and any other terms and conditions agreed or accepted by the Customer and Cardholder.
